CHAPTER 3

How to Apply for Federal 501(c)(3) Status

This is the biggest step. You'll file IRS Form 1023 (or the simplified 1023-EZ if you expect to raise less than $50,000 per year).

The IRS Checklist

Make sure you have all of these ready before you start your application:

Articles of Incorporation
Adopted Bylaws
Approved EIN
Detailed Program Descriptions
Board Member Information
Financial Projections (3 years)

💡 Note: The IRS checks if your activities match your stated mission and benefit the public. Be thorough and honest in your application.

What the IRS Looks For

1. Public Benefit

Your organization must serve a public purpose, not private interests. The IRS wants to see that your programs benefit the community at large.

2. Organizational Structure

Your Articles of Incorporation and Bylaws must show that no private individual benefits from the organization's income, and that assets will go to another nonprofit if you dissolve.

3. Activities Alignment

Everything you do must align with your stated charitable purpose. The IRS reviews your programs to ensure they're genuinely charitable, educational, religious, or scientific.

⏱️ Timeline

IRS processing typically takes 3-6 months, but can take longer during busy periods. Apply early and be patient!
